Terms of Service

Welcome to Phovate AI. By downloading, accessing, or using the Phovate AI mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use Phovate AI. The App is intended for business and commercial use in generating product photography.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

Use the App on devices you own or control
Generate unlimited product photos for commercial purposes
Use generated images in marketing, e-commerce, ads, and print

3. User Content & Ownership

You own all rights to:

Your uploaded product images
All AI-generated output images

We claim no ownership over your content. However, by using the App, you grant us a worldwide, royalty-free license to process your images solely to provide the service.

Prohibited Content: You may not upload images containing nudity, hate symbols, violence, illegal products, or copyrighted material you do not own.

4. Prohibited Conduct

You agree not to:

Reverse engineer, decompile, or extract the App’s source code
Use the App to generate deceptive or fraudulent advertising
Resell, sublicense, or distribute access to the App
Overload servers or attempt to bypass credit limits
Use automated scripts or bots

5. Credits & Payments

Each generation consumes 1 credit (except free trial)
Credits are non-refundable except as required by law
Purchases are final and processed by Apple/Google
Enterprise plans available via email

6. Intellectual Property

The App, its design, AI models (via Fal AI), and branding are protected by copyright, trademark, and other laws. You may not remove any proprietary notices.

7. Disclaimer of Warranties

The App is provided “AS IS” and “AS AVAILABLE.” We disclaim all warranties, including:

Accuracy or quality of generated images
Uninterrupted or error-free service
Fitness for a particular purpose

AI outputs may contain imperfections. You are responsible for reviewing all generated content.

8. Limitation of Liability

To the fullest extent permitted by law, Phovate AI shall not be liable for:

Indirect, incidental, or consequential damages
Loss of profits, data, or business opportunities
Maximum liability: total amount paid by you in the past 3 months

9. Termination

We may suspend or terminate your access immediately if you violate these Terms. Upon termination:

Unused credits are forfeited
You must cease using the App

10. Governing Law

These Terms are governed by the laws of Turkey, without regard to conflict of law principles. Disputes shall be resolved in the courts of Istanbul.

11. Changes to Terms

We may modify these Terms at any time. Changes will be posted in-app and on our website. Continued use after 7 days constitutes acceptance.
